Limited Warranty for PoleFX LED Dance Poles

PoleFX is committed to providing high-quality products that bring joy and creativity to your performances. This Limited Warranty (“Warranty”) outlines the terms and conditions under which PoleFX will provide coverage for your LED dance pole hardware.


1. Scope and Duration of Coverage

  1. Warranty Period: PoleFX warrants to the original purchaser (“Customer”) that the hardware components of the LED dance pole (the “Product”) shall be free from defects in materials and workmanship under normal usage conditions for a period of one (1) year from the original date of delivery.
  2. Proof of Purchase: Proof of purchase is required for all warranty claims.
  3. Non-Transferability: This Warranty is valid only for the original purchaser of the Product and is non-transferable unless otherwise specified in writing by PoleFX.

2. What Is Covered

  1. Structural Hardware: This includes the pole components, connectors, and mounting hardware, excluding normal wear and tear.
  2. Power Supply and Wiring: Internal wiring and connections, provided they have not been subjected to misuse, tampering, or operation outside recommended electrical specifications.
  3. LED Strips: The Product contains six (6) LED strips. If any LED strip is found defective under normal usage within the Warranty Period, PoleFX will replace it, subject to the replacement limits described in Section 3.

3. Replacement Limits for LED Strips

  1. Coverage Limit: During the Warranty Period, Customers are entitled to a maximum of two (2) LED strip replacements free of charge if the strips are found defective.
  2. Additional Replacements: Beyond this limit, any additional LED strip replacements will be offered at a discounted rate for the remainder of the Warranty Period. Shipping costs may apply.

4. What Is Not Covered

This Warranty does not cover:

  1. Normal Wear and Tear

    • Minor scratches, surface scuffs, paint chips, and minor discoloration that do not affect functionality.
  2. Damage Resulting From

    • Improper installation, misuse, abuse, or neglect.
    • Unauthorized modifications, alterations, or repairs.
    • Accidents or impacts, including drops or excessive bending.
    • Water damage or exposure to excessive moisture.
    • Acts of nature or external factors beyond PoleFX’s control (e.g., floods, fires, power surges, extreme weather conditions).
    • Operation outside recommended electrical specifications or voltage requirements.

5. Warranty Claim Procedure

  1. Inspection and Testing of Product Upon Receipt

    • Customers are required to inspect and test the product for visible damage, defects, or functionality within seven (7) days of receiving it. If any issues are identified, customers must notify PoleFX in writing within this period, providing details of the issue and photographic evidence of any visible damage caused during shipping. Failure to inspect, test, and report issues within this timeframe may limit your ability to claim warranty coverage for shipping-related damage.

  2. Contact PoleFX

    • To initiate a warranty claim, email support@polefx.com. Provide proof of purchase and a detailed description of the issue (photos or videos are helpful).
  3. Replacement Parts Shipment

    • In most cases, once the warranty claim is approved, PoleFX will ship you the necessary replacement parts along with instructions for self-installation. A return shipping label for the defective parts will also be included.
  4. Returning Defective Parts

    • After receiving the new parts, you must return the defective parts using the prepaid shipping label provided by PoleFX. If the defective parts are not returned within the specified timeframe, you may be charged for the replacement parts.
  5. Product Returns (If Necessary)

    • If the issue cannot be resolved by replacing the defective parts, or if further inspection is required, PoleFX may request that you return the entire Product. If so, you will receive a Return Merchandise Authorization (RMA) number and detailed shipping instructions. Shipping costs to the designated service center are the responsibility of the Customer, unless otherwise specified by PoleFX.
  6. Repair or Replacement Determination and Return Shipping

    • If approved as a valid warranty claim, PoleFX will repair or replace damaged parts. Customer will cover the cost of return shipping.

6. Limitations and Disclaimers

  1. Exclusive Remedy

    • Repair or replacement of the defective part(s) during the Warranty Period constitutes the Customer’s sole and exclusive remedy under this Warranty.
  2. No Other Warranties

    • This Limited Warranty is the only express warranty made by PoleFX. Any implied warranties of merchantability or fitness for a particular purpose are limited in duration to the Warranty Period, where applicable by law.
  3. Liability

    • To the maximum extent permitted by applicable law, PoleFX shall not be liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, downtime, or damage to other equipment or property, even if PoleFX has been advised of the possibility of such damages.
  4. Jurisdiction

    • Some jurisdictions do not allow the exclusion or limitation of implied warranties or consequential damages, so the above limitations may not apply to you. This Limited Warranty gives you specific legal rights, and you may have other rights that vary from jurisdiction to jurisdiction.

 

7. Dispute Resolution and Governing Law

This Limited Warranty is governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to this Warranty shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Los Angeles County, California, and the arbitrator’s decision shall be final and binding. BY AGREEING TO ARBITRATION, BOTH PARTIES WAIVE THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT. You may opt out of this arbitration provision by notifying us in writing within 30 days of the date of purchase.


8. Customer Responsibilities

  1. Proper Maintenance: Operate and maintain the Product in accordance with the user manual and any technical guidance from PoleFX.
  2. Prompt Reporting: Notify PoleFX promptly of any suspected defect to prevent further damage.
  3. Safe Installation and Use: Ensure the pole is installed securely and used in a safe manner. Do not subject it to excessive force or unsafe environmental conditions.
